The picture shows that the crossing is clearly visible, signed, and possibly lighted (though it’s at-grade, which is something a lot of rail people have been saying is incredibly dangerous for JUST THIS REASON). I don’t see any way this could have been an accident unless the officer was SERIOUSLY impaired in some way, and even then there’s a case to be made for serious negligence.
