It was a provisional victory for the Biden administration, whose climate initiatives have been stymied. A challenge to the rule at issue is still moving through a lower court.
I’ll note that a Trump administration would likely repeat its previous actions, and roll back these rules.
So is this how we’re going to need to pass regulations now that Chevron deference is dead?
